πΌ Payroll Basics for Families Hiring a Nanny
What You Need to Know as a Household Employer
If you pay a nanny more than $2,700/year (as of 2024), the IRS classifies you as a household employer β and that comes with legal responsibilities.
Hereβs what you need to do to stay compliant and protect both your family and your nanny:
β 1. Obtain an Employer Identification Number (EIN)
β’ Apply for free at IRS.gov
β’ This allows you to legally pay and report wages
β 2. File a New Hire Report
β’ Required in most states within 20 days of hire
β’ In Pennsylvania, report at: https://www.humanservices.state.pa.us/csws
β 3. Pay Legally (W-2, Not 1099)
β Do NOT issue a 1099 β this is for independent contractors.
β Nannies must be paid as W-2 employees with taxes withheld.
β 4. Withhold & Pay Employment Taxes
You (the employer) are responsible for:
β’ Social Security (6.2%)
β’ Medicare (1.45%)
β’ Federal Unemployment Tax (FUTA)
β’ State Unemployment Tax (SUTA β varies by state)
Your Nannyβs Share (you withhold from paycheck):
β’ Social Security (6.2%)
β’ Medicare (1.45%)
β’ Federal income tax (optional but recommended)
β’ State/local income tax
π Total employer cost = ~10β12% on top of wages
β 5. Provide a Pay Stub / Record of Earnings
Even if you pay via Venmo or check, you must track gross pay, withholdings, and net pay.
Use a spreadsheet or payroll service (see below π)
β 6. File Year-End Forms
You must:
β’ Provide your nanny a W-2 by Jan 31
β’ File a Schedule H with your personal tax return
β’ Submit federal & state tax payments quarterly or annually
